You and The Golden Secrets agree that any dispute shall be resolved only on an individual basis. You waive the right to participate in any class action, class arbitration, or representative proceeding. No arbitrator may consolidate claims of multiple users, and no arbitrator may preside over any form of class proceeding.

14.4 Exceptions

Notwithstanding the arbitration provision, the following claims may be brought in court: (a) claims for injunctive relief to protect intellectual property rights; (b) claims qualifying for small claims court; and (c) claims that, under applicable law, cannot be subject to mandatory arbitration.

14.5 Opt-Out

You may opt out of this arbitration provision by sending written notice to The Golden Secrets, Attn: Legal Notices, 101 S. Topanga Canyon Blvd., P.O. Box #633, Topanga, California 90290, within thirty (30) days of first agreeing to these Terms. Your notice must include your full name, address, email used at purchase, and a clear statement that you wish to opt out of arbitration. Opting out does not affect any other provision of these Terms.

These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles, and the laws of the United States, as applicable.

Any dispute not subject to arbitration shall be brought exclusively in the state or federal courts located in Los Angeles County, California. You consent to the personal jurisdiction of these courts and waive any objection to venue.

If you are accessing the Site from outside the United States, you do so on your own initiative and are responsible for compliance with the laws of your jurisdiction.
